Acceptable Use Policy

Last updated: 15 October 2026 · Version 2026-10-15

This Acceptable Use Policy sets out what you may and may not do with the Octopus Menu platform. It forms part of our Terms of Service, and words defined there have the same meaning here. You are responsible for making sure everyone who uses your Account follows it.

What you may not publish

  • Content that is illegal in England and Wales or in the place where your business operates.
  • Misleading allergen, ingredient or dietary information (for example, marking a dish as gluten-free when it is not), or leaving out allergen information you are required to give.
  • Misleading prices, charges, offers, promotions or loyalty rewards, or rewards you do not intend to honour.
  • Age-restricted products (such as alcohol or tobacco) without the notices or checks the law requires.
  • Menu items that breach food safety law.
  • Offensive, discriminatory, harassing or sexually explicit content.
  • Content that infringes anyone’s intellectual property, privacy or other rights.
  • Content that impersonates another business or person, or that is designed to deceive Diners, including phishing links and fake reviews.

What you may not do

  • Collect or use Diners’ personal data unlawfully, or use contact details for a purpose the Diner did not give them for, such as adding feedback contacts to a marketing list.
  • Send spam or unsolicited marketing to Diners or anyone else through or because of the Service.
  • Upload malicious code, probe or test the Service’s security without our written permission, or try to access another customer’s account or data.
  • Overload, disrupt or interfere with the Service, or access it by automated means other than the interfaces we provide.
  • Use AI Features to create content that this policy does not allow.
  • Resell, sublicense or share access to the Service without our written agreement.

Consequences of breaking this policy

Depending on how serious the breach is, we may:

  • Warn you: for a first or minor breach, we will contact you and ask you to correct the content within 48 hours.
  • Remove content or suspend your Account: for a serious or repeated breach, or if you do not correct content when asked, pending investigation.
  • Close your Account: for a severe breach, particularly one involving allergen safety, illegal content or misuse of Diners’ data, without refund.

We may also report illegal activity to the relevant authorities.

Allergen safety

Inaccurate allergen information can cause severe injury or death. If we become aware that allergen information on your menu appears to be materially inaccurate and poses a risk to Diners, we may unpublish the menu or suspend your Account immediately and without prior notice. This does not make us responsible for checking your allergen information; that responsibility stays with you.

Reporting a breach

If you see content on the Octopus Menu platform that breaks this policy, please report it to safety@octopusmenu.com.
